By participating in the Bougie Cattle Company Mini-Cow Auction, you agree to abide by the following terms and conditions. Please read carefully.

Payment/Pick Up Terms

The Auction Company will accept only cash, wire transfer, or Venmo for payment. Credit and Debit Cards will not be accepted. Full payment of the invoice is required within 72 hours of auction closure. This is a virtual-live auction with varying run times. Wire transfer info will be provided with the invoice at the close of the auction. If payment is not received within 72 hours of the close of the auction, there will be a late fee of $25 per day the invoice remains unpaid. 

All cattle must be removed from the auction facility within 7 days after the auction’s close, unless prior arrangements have been made with the Auction Company. Failure to remove cattle within this period will incur a $15 per cow per day storage fee. Any cattle not picked up within 28 days of the auction will be deemed a forfeit unless the buyer has made arrangements in writing. 

Fees

A 15% Buyer’s Premium will be added to all won lots. This fee is included in the final invoice and must be paid in full by the winning bidder.

There is no sales tax on cattle. Any other items won will be subject to sales tax of 7.75% 

If a buyer wishes to have their calf weaned, there will be an additional fee of $750. The weaning fee must be paid within 72 hours of close of auction. 

Eligibility to Participate

All prospective bidders must be at least 18 years old and register with I-15 Auctions, doing business as Bid Fast and Last Auctions ("Auction Company") prior to bidding. By placing a bid, you confirm that you have received, read, understood, and agreed to these Terms and Conditions, which are available on the bidder agreement, at the auction facility, or online.

Bidding and Purchase

The bidder offering the highest bid accepted by the auctioneer will be declared the purchaser of the lot. Once a bid is made, it is binding and cannot be retracted. The purchaser accepts the lot upon placing the bid. The Auction Company reserves the right to refuse service to any individual for any reason.

Transportation

  • Cattle Transport: Shipping is available for jewelry only. All cattle must be paid in full prior to transport. No exceptions will be made.

  • Payment Deadline: Full payment of the invoice is required within 24 hours of auction closure. This is a virtual-live auction with varying run times. Wire transfer info will be provided with the invoice at the close of the auction. 

  • Travel Documents & Vaccinations: Bougie Cattle Company will cover any certified veterinary inspections, travel documents, and vaccinations (including those required by the state of destination).

  • Preferred Carrier: Bougie Cattle Company’s preferred carrier is Bob May (530-200-0866), but you are free to use any carrier of your choice. All cattle must be removed from the auction facility within 7 days after the auction’s close. Failure to remove cattle within this period will incur a $15 per cow per day storage fee.

Buy-It-Now Purchases 

We will have a small selection of calves for a Buy-It-Now price before the auction. Calves purchased in the Buy-it-now must be paid for within 48 hours of purchase. This is required as any calves that are not paid for will roll over and be sold in the auction. Any calves that are not purchased during the Buy-it-now will be sold in the auction.  

Termination of Bids

  • Off-Site Auctions: We do not allow cancellations for off-site auctions. All invoices for off-site auctions must be paid in full.

  • Bid Retraction: Bids cannot be retracted unless the retraction is due to an error on the part of the Auction Company. Failing to honor a bid may result in legal consequences.

  • Failure to Pay: Non-payment of auction invoices results in the termination of your purchase contract. You forfeit your right to purchase the lot, and the Auction Company may pursue legal action.

Liability and Indemnification

  • Liability: The Auction Company and Bougie Cattle Company are not responsible for any lost profits, damages, or consequential losses resulting from the auction or shipping process. We assume no liability for items lost, stolen, or damaged during shipping.

  • Indemnification: The bidder, acting in any capacity, agrees to indemnify and hold harmless the Auctioneer, its officers, employees, agents, and consignors from any and all claims, injuries, or damages arising from the purchase or use of any lot, or attendance at the auction.

These Terms and Conditions are governed by the laws of the State of California, and any legal action related to this auction must be brought in California.

Auction Modifications

The Auction Company reserves the right to:

  • Modify the auction dates and times at any time.

  • Change these Terms and Conditions up until the launch of the virtual-live auction.

  • Withdraw any lot from the auction. In the event a lot is withdrawn, any bids placed on that lot will be void.

By participating in this Auction, you acknowledge that you have read, understood, and agree to these Terms and Conditions in full.
